DECISION AND REASONS:
--Following the running of Race 1, the Radioworks Canterbury Mobile Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr S. F. Smolenski, the driver of Bondi Lavra (5), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip excessively.
--Mr Smolenski had indicated on the information that he admitted this breach of the Rule and he confirmed this at the hearing. Mr McIntyre illustrated by means of video coverage that Mr Smolenski had used his whip approximately 26 times in the run home and recommended a fine of $200-00. Mr Smolenski did not dispute the recommendation. I was satisfied that the amount recommended was appropriate and Mr Smolenski was fined the sum of $200-00.
