Following Race 11, Stipendiary Steward Mr R Neal filed an information alleging a breach of Rule 871 (3) in that Jockey S. McCullum gave a victory salute prior to the finish line.

A film of the alleged incident clearly showed Mr McCullum giving a victory salute prior to the winning post.

Mr Neal advised the committee it was Mr McCullum’s first winning ride and he had no previous breaches under this rule.

The committee prior to arriving at a penalty took into account Mr McCullum’s admission of the breach, his co-operation with authorities and the fact it was his first winning ride however these factors were out weighted by the fact he put himself and his mount at risk by his actions and a penalty of $200-00 was warranted.
