Decision:

Following race 2 an information was filed pursuant to Rule 520(4)(c) when it was alleged by the informant,  Mr Sanders that Mr M Yusof, rider of TIVERTON in race two, failed to make the declared riding weight.



Following race 2 an information was filed pursuant to Rule 520(4)(c) when it was alleged by the informant,  Mr Sanders that Mr M Yusof, rider of TIVERTON in race two, failed to make the declared riding weight.
Mr Yusof pleaded guilty to the charge.

Mr Sanders explained to the Committee that the Stewards were concerned that Mr Yusof had not been completely truthful with the Stewards regarding this issue.  He said Mr Yusof led them to believe his official riding weight was 53 kgs when it was declared at 52 kgs.  At weigh-out Mr Yusof was found to be a kilo over, which meant he could not claim his apprentice allowance as would have been expected by off course punters.

Mr Yusof said he thought the trainer had informed the Stewards of his weight problem.  He said the reason he was a kilo over was that the sauna was closed.

PENALTY SUBMISSIONS:
Mr Sanders said the Stewards were concerned that Mr Yusof did not inform Stewards earlier and that punters were disadvantaged.  He submitted a fine of not less than $200 was appropriate.

PENALTY:
The Committee took into account evidence and submissions as presented.  Before imposing a fair penalty they pointed out to Mr Yusof their concern with his late admission to the Stewards and the fact that he had misled them somewhat. 
In Mr Yusof’s favour was his guilty plea and that this was his first weight charge.  Accordingly we impose a fine of $250.
