Following Race 3 an Information was filed pursuant to Rule 638(3b).  The Informant Mr Williamson alleged that Mr Eynon used the whip in an excessive manner on his mount LA GENEROSE.

Mr Eynon admitted the breach.

FACTS:

--

Mr Coles demonstrated the video films and pointed out to the Committee the horse LA GENEROSE, ridden by Mr Eynon racing well back in the field approaching the home turn.  Mr Coles said the horse was under pressure and was weakening from the 500 metre mark.  He said Mr Eynon continued to hit the horse for the length of the straight and believed the forward and backward manner which Mr Eynon used when striking his mount was unacceptable.

Mr Eynon had no comment when asked.

SUBMISSION(s) ON PENALTY:

--

Mr Williamson said that Mr Eynon had not incurred any whip charges in the last 12 months.  However in this case, it was the excessive manner in which Mr Eynon used the whip that was the major concern to the Stewards.  Mr Williamson submitted a fine of $150 - $250 would be appropriate.

REASON(s):

--

The committee considered all evidence as presented.  Mitigating factors are Mr Eynon’s guilty plea and that this was his first charge in the last 12 months.  However the aggravating factor is the manner in which Mr Eynon used his whip, particularly when his mount was well beaten and not responding.

PENALTY:

--

After taking the above facts into account we impose a fine of $200.
