Stipendiary Steward, Mr SC Ching alleged that with approximately 100 metres to run STARRY ANGEL (P Holmes), shifted ground outwards when insufficiently clear, causing several runners to be severely checked.

DECISION AND REASONS:

Stipendiary Steward, Mr SC Ching alleged that with approximately 100 metres to run STARRY ANGEL (P Holmes), shifted ground outwards when insufficiently clear, causing several runners to be severely checked.

In evidence, Mr Ching showed that when the horse began to move out Mr Holmes did not cease riding with the whip, which may have enabled him to correct the movement.

--

On Mr Holmes' behalf, Jockey Mr JC Laking, stated he was following Mr Holmes, his horse ducked out, he said he was riding on adrenaline and the interference was not done on purpose but was accidental.

As Mr Holmes had admitted the charge, and all the evidence, including that heard at the protest hearing supports this, the charge was found proven.

Submissions as to penalty were then heard.

Mr Ching showed Mr Holmes' record, which included a 6-day suspension on 25.11.05, a 3-day suspension on 20.10.05 and a $300 fine on 15.10.05 ? all for careless riding.

Mr Ching asked for a suspension, as relegation had been an outcome of the incident.

--

Mr Laking asked for a half suspension/half fine. Mr Ching countered that as Mr Holmes is an apprentice it is the normal course to suspend unless there are exceptional circumstances.

Mr Holmes is a busy jockey who rides throughout New Zealand.

--

Taking all the above into consideration and allowing for Mr Holmes' admission of the charge, we suspend him for a period commencing after racing at Rotorua on the 15th February and up to and including racing at Awapuni on Thursday 2 March 2006 ? a period of 8 riding days, including 2 premier days.
