Following the running of Race 7, Stubbings Farewell/Late Harvest Imports Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainers, Mr C J & Mrs J De Filippi, alleging a breach of Rule 865 (1) & (2) in that, as the trainers of PARIS HILTON in that Race, they presented the mare without the half blinds that she raced in at the Banks Peninsula meeting on 30 November 2008.



Following the running of Race 7, Stubbings Farewell/Late Harvest Imports Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainers, Mr C J & Mrs J De Filippi, alleging a breach of Rule 865 (1) & (2) in that, as the trainers of PARIS HILTON in that Race, they presented the mare without the half blinds that she raced in at the Banks Peninsula meeting on 30 November 2008.

Mr C J De Filippi had signed the Statement by the Defendant on the information form indicating, firstly, that the Defendants admitted the breach of the Rule and, secondly, that they did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 865 provides as follows:

--

(1)     Subject to sub-rule (2) and (3), every horse shall race with the same or identical gear within a 12 day period.

--

(2)     Horses may race with different gear within the 12 day period referred to in sub-rule (1) hereof when the owner, trainer or person in control of the horse has notified the Secretary of the club conducting the meeting of such change not later than 1.00pm on the day prior to this meeting. . . .

Mr Renault recommended a fine of $100.

Mr & Mrs De Filippi were fined the sum of $100.
