This is an information filed by Assistant Stipendiary Steward Mr S Wallis against Messrs M Purdon and G Payne, trainers of SECRET POTION, alleging a breach of Rule 864 (2) (d) in that there was a failure to correctly affix the centre hopples connecting strap, the strap coming undone in the run up to the start, resulting in the horse galloping and the starter declaring a false start.
--Ms N Molander, on behalf of the defendants, admits the breach and is present at the hearing.
--Mr Wallis said the buckle on the strap came undone and the horse galloped causing the starter to declare a false start. The start of the race was delayed and SECRET POTION was sent to the outside of the front row.
--Stipendiary Steward Mr J Muirhead said the gear was in new condition and stiff and should have been taped. Ms Molander said the gear would be taped in future.
--PENALTY
--Mr Wallis said the defendants had no relevant breaches of the rules recorded against them; the breach had caused a false start and delayed the start of the race. He said the recommended starting point for penalty was a fine of $250 and the race was a heat of the Fillies Series. He suggested a fine of $250.
--Ms Molander said she had not been careless and was a victim of circumstances.
--In fixing the penalty the committee takes into account the guilty plea, the defendants’ clear record, the submissions of Mr Wallis and Ms Molander, the offending was mid range, and the recommended starting point. In addition, the chances of SECRET POTION were affected by being sent to the outside barrier position. Balancing all of those matters, a fine of $250 is imposed.
