Decision:

Following race 4 Stipendiary Steward Mr McIntyre alleged that Mr Walkinshaw, driving RIDE IN A ROLLS, failed to drive his horse out to the finish of the race. 



Following race 4 Stipendiary Steward Mr McIntyre alleged that Mr Walkinshaw, driving RIDE IN A ROLLS, failed to drive his horse out to the finish of the race.  Video evidence confirmed this.  He led and after turning for home in front, he was run down to finish 5th.  Mr Walkinshaw gave little or no demonstrable urgings over the final stages and after seeming to be holding 4th, was run down to 5th beaten by a head.

Mr Walkinshaw said that his filly was doing her best and he had hit her 8 or 9 times in the straight, that she was only a 2-year-old and, in his opinion, would not have done any better no matter how hard he had hit her.  He said he had flicked her 4 times before ceasing at the 30 metres.

Rule 868(3) reads "every horseman shall drive his horse out to the end of the race if he has a reasonable chance of running 1st, 2nd, 3rd, 4th, 5th, or 6th".

As Mr Walkinshaw failed, in our opinion, to comply with this Rule, we find the charge proved and ask for submissions at to penalty.

SUBMISSIONS AS TO PENALTY:

Mr McIntyre said the most recent charge under this Rule at Addington, Mr M, was fined $500 and involved a horse finishing 3rd when it could possibly have been second.  Mr Walkinshaw said he had been fined three times for excessive use of the whip and once for "hitting without need".  Mr McIntyre confirmed this information.

DECISION:

To the Committee it appeared that Mr Walkinshaw's horse could have finished 4th if driven out but was run down in the final stages and came fifth.  Bearing all the facts in mind and the loss of 4th place at Oamaru compared with 2nd place at Addington, we fine Mr Walkinshaw $400.
