Following Race 9 an Information was filed pursuant to Rule 638 (1) (d). The Informant, Mr J Oatham, alleged that near the 250 metres, Miss Spratt allowed her mount, ALAGANT SATIN, to shift out when not clear of CASABELLA LANE (C Lammas) causing that horse to be hampered.

Following Race 9 an Information was filed pursuant to Rule 638 (1) (d). The Informant, Mr J Oatham, alleged that near the 250 metres, Miss Spratt allowed her mount, ALAGANT SATIN, to shift out when not clear of CASABELLA LANE (C Lammas) causing that horse to be hampered.
--Miss Spratt admitted the breach.
--As the charge resulted from the previous protest (Information No 043) involving the 2 horses above neither Mr Oatham nor Miss Spratt wished to bring forward any new evidence. This is because the films showing the alleged interference and all the pertinent evidence were well demonstrated and discussed.
--PENALTY SUBMISSIONS
--Mr Oatham produced Miss Spratt’s record which showed this to be her 6th charge in the last 12 months. Mr Oatham told the Committee that he believed Miss Spratt’s level of carelessness in this charge was at the lower end. However he reminded the Committee that a relegation had resulted from the breach and it was in a Group 2 race. He submitted a 5 – 6 day suspension would be appropriate and left it to the discretion of the JCA as to whether they imposed a fine as well. He also added Miss Spratt had incurred a suspension at Racing Tauranga on 11 December 09 which would conclude on 20 December 09.
--PENALTY
--The Committee carefully considered all evidence and submissions before imposing an appropriate penalty. Mitigating factors in this charge are Miss Spratt’s guilty plea and her level of carelessness which the Committee also finds to be low. However these must be balanced against the aggravating factors of a relegation taking place in a Group 2 race and Miss Spratt’s record which can only be described as fair. The Committee does not believe that it is appropriate to impose a fine in addition to a suspension because Miss Spratt’s carelessness was low and the relegation affected only 5th and 6th places.
--Accordingly, after taking all the above factors into account we impose a suspension on Miss Spratt from riding in races which is to start after racing on 20th December 09 and conclude after racing on 30th December 09 (5 days).
