Mr Ching requested a ruling pursuant to rule 865A in that WITHOUT A TRACE (J Misbah) be declared a non-starter after the gate on the starting stall failed to open properly denying the gelding a fair start in race 3.
----Mr Ching demonstrated on the front-on video that gate number 8 (WITHOUT A TRACE) on opening immediately swung back, hitting the gelding on the head as it endeavoured to jump. WITHOUT A TRACE then jumped out awkwardly seemingly avoiding the possibility that the gate might again spring back. WITHOUT A TRACE was last away and was immediately hunted up by Mr Misbah, to sit in 2nd last position in the field.
----Mr Misbah described the gate springing back on to his horse and the fact that he was inconvenienced. He said he had instructions to go to or the near front of the field on jumping but he was denied this opportunity by the gate malfunctioning.
----We are satisfied in accordance with rule 865A WITHOUT A TRACE was both prevented from taking an effective part in the race due to a mechanical failure of the starting gate and was also denied a fair start which materially prejudiced its chances. In these circumstances we declare the horse to be a non-starter.
