DECISION & REASON
--Following the running of race four the Stipendiary Stewards lodged an information instigating a charge against J S Bullard. Mr Ching alleges that Mr Bullard (?Six Caral?) allowed his horse to take the line of ?GUFI? (J Cameron) by shifting inward when not clear approximately 300 metres after the start of the race.
--At the outset of the hearing Mr Bullard confirmed that the breach was not admitted.
--Ms Cameron in response to being asked by Mr Ching what happened in the incident said that her horse "had jumped out well and was moving into the first bend when Mr Bullard's horse, which had drawn out wide, moved across my horse and I had to steady it as was not clear".
----Mr McLachlan, on behalf of the Stipendiary Stewards presented the video evidence which showed that Mr Bullard drew two from the outside, he came across the field towards the inside and as he proceeded across Ms Cameron had to take hold of her horse which resulted in interference to the ?Circle of Gold? (J C Bates) and ?Cancelled? (J R Todd). He described what happened as a chain reaction.
----Mr Bullard in his evidence said that he drew one from the outside, his horse moved across and changed legs, rolled in on the point of the corner. He acknowledged in response to a question from the chair that he had looked round twice prior to the incident but had continued to move across towards the rails.
----In response to Mr Bullard's evidence Mr Ching said that Mr Bullard was under an obligation to ensure that he was his own length and another length clear of the horse inside him. The video evidence clearly showed that he was not. He also submitted that rather than Ms Cameron's horse over racing, it was on the bit and only appeared to be over racing after she had to check it as a result of the incident. Mr Ching also said that Mr Bullard's horse changed strides after the evidence and referred to the video evidence in support.
----The Committee after reviewing the evidence given by the Stipendiary Stewards and Ms Cameron is of the view that their evidence correctly reflects what happened rather than Mr Bullards. It is clear from the video evidence that the change in leg occurred after the interference to Ms Cameron's horse.
----The charge is accordingly found proven.
----In respect of penalty Mr Ching advised the Committee that over the last twelve months Mr Bullard had one breach of the careless riding rule which was in May of this year and as a result he was suspended for 3 days. He also submitted that the carelessness on this occasion was in the mid range and that the incident had raised concerns of rider safety and that a number of horses were affected in the chain reaction. He submitted that the only appropriate penalty was suspension.
----Mr Bullard, on his part, indicated that he would prefer a fine as he was a senior rider riding in all South Island meetings and in meetings, particularly in the lower North Island.
----The Committee believes that a starting point would be a 4 day suspension, however, giving Mr Bullard credit for his good riding record and allowing for opportunities for South Island riders believes that the appropriate suspension is 3 days. Mr Bullard indicated that he had been contacted about riding in the North Island in the first week of October but that he had no commitments. Mr Bullard's licence to race is accordingly suspended from the completion of riding today, 30th September 2006, until the completion of racing on 14th October 2006 (an effective 3 day penalty).
