Decision:

An Information instigating a protest was laid by Stipendiary Steward Mr T TAUMANU following Race 2, against Horse 7, JAZMIN ALICIA placed 3rd by the Judge on behalf of the connections of Horse 6 BB GILL placed 10th by the Judge on the grounds of interference which occurred just after the start.



An Information instigating a protest was laid by Stipendiary Steward Mr T TAUMANU following Race 2, against Horse 7, JAZMIN ALICIA placed 3rd by the Judge on behalf of the connections of Horse 6 BB GILL placed 10th by the Judge on the grounds of interference which occurred just after the start.

The Connections of JAZMIN ALICIA were represented by Driver/Trainer Mr R Brosnan who challenged the protest.  BB GILL’s interests were represented by Driver Miss Chilcott.
Mr Taumanu referred video footage of the start of the race and indicated where the inwards movement of JAZMIN ALICIA had interfered with BB GILL.  He said the horse immediately inside Miss Chilcott had not caused any interference.

Mr Brosnan indicated the horse on his immediately outside which had moved towards his just after the start and suggested that this movement had contributed to his horse’s interference.  Examination of this movement showed WAIMARAMA was behind Mr Brosnan’s horse.

Miss Chilcott confirmed that her horse had been interfered with and that it had broken as a result of the contact with her horse and Mr Brosnan’s Cart.

DECISION
The committee is satisfied that JAZMIN ALICIA caused interference to BB GILL shortly after the start of Race 2.  This interference caused BB GILL to break up and this horse finished the race at the tail of the field.  Video footage confirms our finding and we are further satisfied that the suggestion by Mr Brosnan of contributing interference from his outside from WAIMARAMA did not occur.
Accordingly the Judges placings are amended to show JAZMIN ALICIA being placed immediately behind BB GILL in tenth place.
