An information was lodged by Stipendiary Steward Mr JM Muirhead against Mrs C Rixon the Driver of Spicey alleging that Mrs Rixon used her whip excessively when driving Spicey over the concluding stages of the Race.
----Mrs Rixon admitted the breach and did wish to be present at the Hearing.
----A copy of the Use of Whip Guidelines was handed to Mrs Rixon.
----Mr Muirhead demonstrated the incident using the video film and showed that from the home turn Mrs Rixon used the whip an estimated 21 times and in that she used the whip at least 17 times consecutively. Mr Muirhead also advised the Committee that Mrs Rixon as a visiting Driver did not report to the Stipendiary Stewards prior to the commencement of the Meeting and as a result had not sought advice on any of the Rules.
----Mrs Rixon acknowledged the use of the whip which was evident on the video film but said that she wasn?t aware of the NZ Rules relating to the use of the whip. She said that in Australia the Stewards approach the Drivers to discuss the Rules and not the other way around. Mrs Rixon did acknowledge that if she was driving on the roads in New Zealand she would make sure she would have a knowledge of the road Rules but she had not bothered to find out about the Rules in relation to driving on New Zealand race tracks.
----In respect to penalty Mr Muirhead recommended a fine of $250.00 and Mrs Rixon said again that she was not aware of the Rules and though that such a fine was excessive.
----In taking all matters into account and noting Mrs Rixon's guilty please the Committee finds that the use of the whip was excessive and accordingly imposed a fine of $250.00.
