Decision: This is a protest lodged by Mr Knowles, stipendiary steward, alleging that RAE GALLEON placed 1st equal by the Judge broke from its gait over the final stages and was lapped on by the POPZ DELIGHT and INDA PHOTO as provided by Rule 870(5).

This is a protest lodged by Mr Knowles, stipendiary steward, alleging that RAE GALLEON placed 1st equal by the Judge broke from its gait over the final stages and was lapped on by the POPZ DELIGHT and INDA PHOTO as provided by Rule 870(5). The Judge’s placing were:

The protest was lodged pursuant to Rule 870(5) and seeks relegation of RAE GALLEON.

Mr Knowles demonstrated on the videos that RAE GALLEON galloped just on or after the line. At this time it was lapped on POPZ DELIGHT and INDA PHOTO. He acknowledged it was very difficult to determine from the video evidence just when the horse had galloped. It may have lost its gait right on the line.

Mr Negus, trainer of RAE GALLEON and Mr Jones, its driver, both viewed the video and indicated they believed the horse galloped just after the post.

The print of the photo finish was requested. This was in black and white and was not very clear. It showed both of the front legs of RAE GALLEON were in the air as it crossed the line. When the video was slowed right down it appeared RAE GALLEON had galloped right on or half a stride past the line. When the two front legs came down on to the track together, indicating that the horse was in a gallop, this was clearly past the post.

In these circumstances I find that I am not satisfied to the required standard that RAE GALLEON was in a gallop as the horse crossed the line and was lapped on to POPZ DELIGHT and INDA PHOTO. I accordingly uphold the Judge’s placings.
