Decision:

A Protest was lodged after Race 5, The www.southlandharness.co.nz Special Handicap Trot, alleging Horse 10, ANTS galloped in excess of 150 metres during the running.

A Protest was lodged after Race 5, The www.southlandharness.co.nz Special Handicap Trot, alleging Horse 10, ANTS galloped in excess of 150 metres during the running.

Present at the hearing were Trainer of ANTS, Mr G J Anderson and Driver Mr D J Dunn. 

--

Film of the incident was shown by Stipendiary Steward Mr C J Allison.  This shows ANTS going into a gallop at about the 1900 metre point, and continuing on in a gallop passed the 800 metre track marker before settling.

This distance in the opinion of Stipendiary Steward Mr Knowles, was over the 150 metre distance permissible before coming subject to the Breaking Horses Regulations and a breach of Rule 870 (3).  Mr Knowles further alleged that under Rule 869 (8) (a) ANTS may have gained an advantage by its conduct prohibited by any preceding provision of this Rule and thus sought to have ANTS disqualified.

Mr Dunn gave evidence to the effect that there are no exact marker pegs to determine how far his horse galloped and that the distance determined by the Stipendiary Stewards is an approximate distance only.

Mr Anderson confirmed the view of Mr Dunn and stated that it would be unfair to disqualify his horse on that basis.

--

Mr Knowles in summing up reiterated that it was the view of the Stewards that ANTS had galloped in excess of 150 metres.

--

The Committee adjourned to deliberate, reviewing the video footage several times.  It remained unclear to the committee to be able to determine accurately the distance ANTS galloped by counting the markers passed until the horse finally settled.

On resuming the hearing the Committee delivered the following oral decision.

The Committee cannot be absolutely certain that Horse 10 ANTS, was in a continuous gallop in excess of 150 metres and therefore the Protest is dismissed.
