Following Race 6 an Information was filed pursuant to rule 638 (3) (b).  The Informant, Mr M Williamson alleged that Mr C Leveque, rider of the winner, KHAPTION, was outside the acceptable guidelines with his use of the whip.

Mr Leveque admitted the breach.

--

FACTS:

--

Mr Coles demonstrated the video films which clearly showed Mr Leveque strike his mount approximately 12 times before the 200 metres without the necessary respite.

SUBMISSION(s):

Mr Leveque said he was unaware of how many times he had struck his mount but as a part owner he felt he was not hurting it in any way.

--

SUBMISSION(s) ON PENALTY:

--

Mr Williamson said this was Mr Leveque’s second whip charge in the last 3 months so he was clearly not getting the message that overuse of the whip is unacceptable.  Therefore he submitted a fine of $300 - $400 would be appropriate in this case.

Mr Leveque had no submissions to make on penalty.

--

The Committee considered the submissions as presented before imposing an appropriate penalty.  Mr Leveque’s guilty plea and record were also taken into account.

Taking all the above factors into account the Committee is satisfied that a fine of $350 is appropriate and we rule accordingly.
