RACEDAY JUDICIAL COMMITTEE DECISION
--Informant: Mr M Williamson
--Defendant: Mr C Leveque
--Information No: 7656
--Meeting: Cambridge Jockey Club
--Date: 7 July 2010
--Venue: Te Rapa
--Race: 6
--Rule No: 638 (3) (b)
--Judicial Committee: R Seabrook, Chairman – Committee Member, B Tims
--Plea: Admitted
----
CHARGES:
--Following Race 6 an Information was filed pursuant to rule 638 (3) (b). The Informant, Mr M Williamson alleged that Mr C Leveque, rider of the winner, KHAPTION, was outside the acceptable guidelines with his use of the whip.
----
Mr Leveque admitted the breach.
----
FACTS:
--Mr Coles demonstrated the video films which clearly showed Mr Leveque strike his mount approximately 12 times before the 200 metres without the necessary respite.
----
SUBMISSION(s):
--Mr Leveque said he was unaware of how many times he had struck his mount but as a part owner he felt he was not hurting it in any way.
----
SUBMISSION(s) ON PENALTY:
--Mr Williamson said this was Mr Leveque’s second whip charge in the last 3 months so he was clearly not getting the message that overuse of the whip is unacceptable. Therefore he submitted a fine of $300 - $400 would be appropriate in this case.
----
Mr Leveque had no submissions to make on penalty.
----
REASON(s):
--The Committee considered the submissions as presented before imposing an appropriate penalty. Mr Leveque’s guilty plea and record were also taken into account.
----
PENALTY:
--Taking all the above factors into account the Committee is satisfied that a fine of $350 is appropriate and we rule accordingly.
