DECISION & REASONS:

This information alleged a breach of Rule 871(1)(d) for careless riding by apprentice jockey, P T Holmes (STEREO), in that he shifted out when not the required distance clear of MAREA (V Colgan). The breach was admitted and Mr. Holmes was assisted by Jockey A Peard.

Stipendiary Steward, J Oatham, demonstrated the incident on video, pointing out the outward movement over the concluding stages about 250 metres from the finish.

Mr. Coles asked the Committee to take note that Mr. Holmes had been suspended previously on 17 April 2004 and a period of three days had been imposed. However, he had a good record and was entitled to credit for admitting the breach. It was an error of judgement situation but there had been a severe check at a vital stage and a period of suspension ought to be imposed.

Mr. Peard asked that the Committee consider a fine rather than suspension because Mr. Holmes needed the racing opportunities having recently recovered from a racing injury and was finding it difficult to keep his weight at an acceptable level without continued riding.

The Committee took into consideration these matters and giving credit for the guilty plea, co-operation and good record nevertheless agreed a period of suspension should be imposed. It did not believe a fine would be appropriate in the circumstances but a suspension for three days would take effect from the conclusion of racing on 3 November 2004 until the conclusion of racing on the 9 November 2004.
