Following the running of Race 5, a protest was lodged by the Stipendiary Stewards against horse No 2, Last To Pass (L O?Reilly), placed 2nd by the Judge, on the grounds of interference to horse No 1, Lukensam
Following the running of Race 5, a protest was lodged by the Stipendiary Stewards against horse No 2, Last To Pass (L O?Reilly), placed 2nd by the Judge, on the grounds of interference to horse No 1, Lukensam (J Dunn), placed 11th by the Judge, that interference occurring racing into the first bend.
----The placings were: 1st - No 8, 2nd - 2, 3rd - 5, 4th - 4, 5th -9, 6th - 14.
----Introducing the protest, Chief Stipendiary Steward, Mr Escott, explained that shortly after that start and heading into the first bend Mr O?Reilly (Last To Pass), in going to the lead, crossed Mr Dunn (Lukensam), which had drawn one on the inside. In so doing, he hit the leg of Lukensam, causing that horse to break. It continued in its break and moved out further on the track, still in a gallop, and lost its chance. Mr Escott used the video of the race to show the incident.
----Mr O?Reilly, in his account, denied his sulky wheel hit the leg of Lukensam. He said that there was a general tightening going into the bend, that Mr Dunn had ?the stick? on Lukensam to keep him up and his leg actually struck the wheel of his cart. It was conceded that there was some pressure from on his outside from Precious Amrik (A Puha), but Mr O?Reilly denied causing the incident.
----This was disputed by Mr Dunn who reiterated that Mr O?Reilly had hit the leg of his horse with his wheel.
----Decision:
----(Given the next race was scheduled to start, the parties were advised that a brief decision was to be given, with a written decision to be available later).

This was a protest by horse no 1, Lukensam, placed 11th by the Judge, against horse no 2, Last To Pass, placed 2nd by the Judge, on the grounds of interference at the first bend.
----Evidence was such, and there is no dispute, that Lukensam (J Dunn), on the inside, broke as Last To Pass (L O?Reilly) challenged for the lead into the first bend. However, there is a clear conflict of evidence. Mr Dunn said that Mr O?Reilly's wheel hit the leg of his horse, and Mr O?Reilly said, essentially, that Mr Dunn's horse was ?under the stick? at the time and moved out, hitting the wheel of his cart. There was also what could be described, and was referred to, as a general tightening, possibly caused by some pressure on the outside of Mr O?Reilly but that was not otherwise pursued. The film of the incident was not of great benefit.
----I have to establish if there was interference and, in the circumstances, I cannot be satisfied that there was. On the evidence, I am inclined to Mr O?Reilly's account of the incident. Whilst Lukensam broke and lost its chance in the race, I am not satisfied that it was attributed to the actions of Mr O?Reilly and, accordingly, the protest is dismissed.
