Following Race 10 an Information was filed pursuant to Rule 871 (1) (d) when it was alleged by the Informant Mr A Coles that Mr A Peard allowed his mount AVE MAREE to shift inwards near the 1100 metres when not sufficiently clear

Following Race 10 an Information was filed pursuant to Rule 871 (1) (D) when it was alleged by the Informant Mr A Coles that Mr A Peard allowed his mount AVE MAREE to shift inwards near the 1100 metres when not sufficiently clear of BALLYMORE LASS (S Collett) who was checked. Mr Peard admitted the breach.

Assistant Stipendiary Steward Mr Williamson demonstrated the video films and showed that Mr Peard was racing three wide at the 1100 metre mark and then moved in to a position one off the rail. When Mr Peard moved in he was only ? length clear of Ms Collett on his inside. This inward movement caused Ms Collett to check her mount quite sharply.

Mr Peard said in his submissions that Ms Collett didn?t want to be in front and in his opinion he only 'shaved? her for 3 strides or so when he came across. He asked the Committee to consider his guilty plea and added he had a ride in a $50,000 race at Awapuni on 25 April which he would like to honour.

Mr Coles produced Mr Peard's record which showed two recent charges being 24 March 2007 (4 days) and 7 November 2006 (3 days). He said the Committee should consider Mr Peard's guilty plea but also the fact that Mr Peard moved from a 3 off position to a 1 off when not clear of BALLYMORE LASS who did receive a sharp check.

DECISION

The Committee considered all submissions and took into account Mr Peard's record and his guilty plea. However, this has to be balanced against the offence itself which did show clearly Ms Collett received a sharp check from Mr Peard moving when insufficiently clear.

We believe a suspension in this case is appropriate and accordingly suspend Mr Peard from after racing on the 18th April until after racing on the 26th April 2007 (3 days).
