--PENALTY
--Prior to hearing submissions on penalty Mr Goodwin presented Mr Waddell's record which demonstrated no previous breaches of this rule.
--Mr Goodwin then proceeded with his submissions which, in essence, were that as this was the first time Mr Waddell had been charged under this rule then the matter should be best dealt with by way of a fine.
--Mr Waddell, in his submissions, advised the committee that he was having issues with his weight and that as this was the first time he had breached this rule then he concurred with Mr Goodwin in that he should receive a fine.
--The committee having carefully considered the submissions of Mr Goodwin and Mr Waddell are of the opinion that a fine is the appropriate penalty in this case, and after taking into consideration penalties imposed by other judicial committee's we determine that Mr Waddell be fined the sum of $200.00
