--Following the Rangiora H.R.C. meeting held at Rangiora on 1 July 2007 the General Manager of HRNZ gave written permission for an information to be filed charging Mr P. C. McClelland with a breach of Rule 869(2)(a), excessive use of the whip.

DECISION AND REASONS:
--This matter was heard at the NZMTC meeting on 2 August 2007.
--Following the Rangiora H.R.C. meeting held at Rangiora on 1 July 2007 the General Manager of HRNZ gave written permission for an information to be filed charging Mr P. C. McClelland with a breach of Rule 869(2)(a), excessive use of the whip. This charge arose after the running of Race 8, The Three Mike Browns Of North Canterbury Mobile Pace, and the information was laid by Stipendiary Steward Mr N. M. Ydgren.
--It was alleged that Mr McClelland, the driver of "Prince Lochie" (9), had used his whip excessively over the concluding stages. Mr McClelland had indicated on the information that he admitted this breach of the Rules and that he did not want to attend the hearing. Video coverage of the incident was viewed and this showed that Mr McClelland had used his whip without respite on 23 or 24 occasions in the straight.
--Penalty: A fine of $200-00 was recommended. Taking into account the guilty plea and previous penalties for a breach of this Rule I was satisfied that a fine of $200-00 was appropriate and Mr McClelland was fined this amount.
