Decision
--An Information, (352), was lodged by Stipendiary Steward Mr J Oatham under Rule 330 (3) (c) alleging that Apprentice Izuan Khairil failed to make the carded weight for KIDUNOT in Race 10 the ILT Foundation 2000. Mr Khairil admitted the breach and was assisted throughout the hearing by Trainer Mr Sean Bellew.

Mr Oatham told the Committee that Mr Khairil had advised him the evening prior to the races that he could not make the weight for KIDUNOT. Mr Khairil states that it was his first day back riding after a three week suspension and although he had tried to make the weight he was unable to do so.

Mr Khairil also stated that he had rung the Trainer on the evening prior to raceday to inform him.

Mr Bellew told the Committee that Mr Khairil had been pro-active, and he asked that the Committee give him credit for this when fixing his penalty.

Mr Oatham stated that Mr Khairil had previously breached the same rule on two previous occasions in the past twelve months, although both offences were in April 2009. On the 13/4/09 at the Riverton Racing Club Mr Khairil was fined the sum of $150.00, and on the 26/4/09 at the Marlborough Meeting Mr Khairil was fined the sum of $300.00.

The Committee, in fixing the penalty, gave some credit for Mr Khairil being pro-active by informing both Mr Oatham and the Trainer of KIDUNOT.

Mr Khairil was fined the sum of $100.00 and reminded of his professional obligations.
