| -- Race No.2 Rule 869(3)(b) --DECISION AND REASONS: --An information lodged by Stipendiary Steward, Mr J Muirhead, against Mr W Taylor driver of CASTLETON GOLD alleging a breach of the above rule, Careless Driving, in that he drove his horse carelessly with about 500m to run, when he allowed the horse to strike the back of the sulky of TEACHER?S PRIDE, causing his horse to break and lose all chance. Mr Taylor admitted the breach and was present at the hearing. Mr Muirhead demonstrated the incident by use of the video film. He said Mr Taylor had leaned down to pull the ear plugs and at that time his horse, which was full of running, ran into the back of the sulky of TEACHER?S PRIDE and broke. ----Penalty: ----Mr Muirhead said that Mr Taylor had committed a similar breach of the rules on 28/1/05 and was fined $200. He said the offending was in the mid range on the scale of seriousness. He suggested a suspension of 2-4 days. Mr Taylor confirmed that he was in the process of pulling the earplugs and the horse took off. He said he shouldn?t have pulled the earplugs at that time. He said he only drove his own horses and only had one horse in work at the present time. He suggested a suspension of 2 days. In imposing penalty the committee took into account the following matters ? --
Balancing all of those matters, the committee decided that a suspension of Mr Taylor's horseman's licence for 3 days was the appropriate penalty and accordingly suspended his horseman's licence until the end of racing on the 30/9/ |
