DECISION AND REASONS:
--Following the running of Race 8, the Paul Renwick ? Celebrating 30 Years In Business Handicap Pace, an information instigating a protest was laid by Stipendiary Steward Mr N. G. McIntyre alleging a breach of Rule 869(8) and the Home Straight Regulations. The information reads as follows.
------"This is a protest by horse number (5) placed 6th by the judge against horse number (7) placed 2nd by the judge on the grounds of interference in the run home and a breach of the home straight regulations."
--Rule 869(8) reads as follows.
--"The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
--- ------
- may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or --
- may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -
- --
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby."
----The relevant Home Straight Regulation reads:
--"In the last lap of any race the leading horse on the running rail shall, upon entering the home straight, maintain as straight a course possible parallel to the running line and allow the trailing horses full access to the expanded inside lane"
--Present at the hearing were Mr R. A. Sharpe who was the driver of "Fake Chance", and Mr B. N. Orange who was the driver of "Jays Debut". Both drivers advised that they represented the connections of their respective horses.
--Stipendiary Steward Mrs K. Williams showed video coverage of the concluding stages of the race showing Fake Chance running off the fence taking the line of Jays Debut and causing this horse to break. Mr Orange gave evidence that Jays Debut had its back leg touched by Fake Chance causing his horse to break. Mr Sharpe reported that his horse had run out due to the blinkers he was wearing.
--At this stage Mr Sharpe told the Committee that he did not contest the protest. Therefore the protest was upheld.
--The amended places are as follows.:
