DECISION & REASONS:
Stipendiary Steward Mr S Ching alleged that on weighing in PIERO, ridden by C Grylls, weighed in 0.60kgs under his weigh out weight at 59.5kgs. PIERO finished in third place. Mr Ching said he was present when Mr Mills supervised Mr Grylls weighing back in after the race.
Mr Ching called Mr Mills who gave evidence that Mr Grylls had weighed in 0.60kgs light at 58.9kgs. Mr Mills said he drew the matter to Mr Grylls' attention and Mr Grylls confirmed the degree of variance.
In evidence, Mr Grylls said that after weighing out he found the girth on his saddle was too big and changed it. He said the one he removed was large and heavy and the replacement was smaller. He said he did not re-weigh out before the race.
Mrs Stuart, the trainer, said she had supplied the replacement girth and thought that Mr Grylls would have weighed out again. She had two horses in the race and was busy.
Rule 857(3) is clear. Mr Grylls "cannot draw the proper weight". He is .1 kg over the allowed .5 kg. In these circumstances the horse "shall be disqualified for the race".
Judge's placings are accordingly amended to read -
