Mr Allison, stipendiary steward, instigated a protest after race 10 alleging that with approximately 1900 metres to run RED HOT HAT (J H Cox), which was placed 3rd by the Judge, broke with FULLAVINO (K Barclay) and LAUGHALOT (J W Cox) being checked). He sought relegation of RED HOT HAT to behind FULLAVINO (placed 11th) pursuant to R 869(8)(b).

Mr Allison, stipendiary steward, instigated a protest after race 10 alleging that with approximately 1900 metres to run RED HOT HAT (J H Cox), which was placed 3rd by the Judge, broke with FULLAVINO (K Barclay) and LAUGHALOT (J W Cox) being checked). He sought relegation of RED HOT HAT to behind FULLAVINO (placed 11th) pursuant to R 869(8)(b).
--Judges placings were: 4, 16, 3, 12, 7.
--Mr Allison first demonstrated the incident on two video angles. These showed that RED HOT HAT broke and that FULLAVINO, which had moved into the trail behind RED HOT HAT, broke almost simultaneously. There was no contact between RED HOT HAT and FULLAVINO. Ms Barclay could be seen to be pulling FULLAVINO out to move around RED HOT HAT just prior to FULLAVINO breaking.
--Ms Barclay gave evidence that there was no contact with RED HOT HAT. She said that she had not had to take hold of FULLAVINO and was moving her horse wider on the track to progress around the breaking RED HOT HAT when FULLAVINO had galloped. She said she had not suffered interference from RED HOT HAT and that the move she was making was one that she would normally make in a race to move around a tiring runner. She said FULLAVINO should not have galloped and it appeared “to have broken in sympathy” with RED HOT HAT. She added her horse had “not shown anything” during the race and that she had had “difficulties with the horse before”. Mr Allison confirmed that FULLAVINO had previously been given a warning for breaking during the running of a race.
--Mr J W Cox driver of LAUGHALOT said he should have moved inside FULLAVINO rather than having gone around the outside of that horse. Our viewing of the video suggests that that alternative course of action may have created some risks for Mr Cox and we believe his actions at the time to be understandable. But the point is that he was forced wider by the breaking FULLAVINO and Ms Barclay has said her horse broke free of interference from RED HOT HAT. Any interference to LAUGHALOT cannot thus be sheeted home to RED HOT HAT.
--In light of the clear evidence from Ms Barclay, which is supported by the video evidence, we find that RED HOT HAT has not interfered with the chances or progress of FULLAVINO or LAUGHALOT and in these circumstances we dismiss the protest.
--The placings are as the horses crossed the line.
