R Neal filed an information alleging a breach of Rule 638(1)(d) in that near the 1800m R Norvall the rider of Pascals A Babe shifted inward dictating Frills (A Calder) into the line of Miraflores (J McDonald) which was checked.

The rule was read and confirmed.

Mr Neal demonstrated on the films available Mr Norvall at approximately 200m after the start coming across the outside when moving forwards towards the lead, shifts in and dictates the line of A Calder (Frills), who then takes the line of J McDonald (Miraflores) which was checked.

--

Mr Neal had interviewed the riders concerned and J McDonald was well established in the gap, he had anticipated what was about to happen and was able to take a hold but was checked.

--

Mr Norvall was at no stage one length clear of A Calder.  Mr Norvall confirmed Mr Neal’s account of the incident.

The charge is proven.

Penalty

--

Mr Neal produced a record of two previous charges of Mr Norvall’s in the previous 12 months, April 2009 of five days and October 2009 of four days.  The Stewards regard this record as good, Mr Norvall rides regularly in North Island, this incident is rated towards the lower end and seek a penalty relative to that and the riders record.  Mr Norvall asked the committee to take his good record into account and would seek a penalty commencing after the 17th February 2010.

Decision

In reaching their decision the committee have taken into account the admittance of the breach by Mr Norvall, his good riding record and the Stewards assessment that this offence was at the lower end of careless.  Mr Norvall has made an error of judgement on this occasion and the committee imposes a term of suspension from the close of racing on Wednesday 17th February up to the close of racing on Sunday the 21st February 2010 (4 days).
