Stipendiary Steward, Mr N Goodwin, lodged an information alleging jockey Andrew Calder, the rider of MELLICIOUS in race three allowed his mount to move inwards when not the required distance clear of KONINI BABE (Mark Barnsley), STARK HORIZON (Paul Taylor) and MISS SHINANIGIN (Mathew Cameron) resulting in that runner receiving severe interference and hitting the running rail in the back straight.

DECISION AND REASONS:
--Stipendiary Steward, Mr N Goodwin, lodged an information alleging jockey Andrew Calder, the rider of MELLICIOUS in race three allowed his mount to move inwards when not the required distance clear of KONINI BABE (Mark Barnsley), STARK HORIZON (Paul Taylor) and MISS SHINANIGIN (Mathew Cameron) resulting in that runner receiving severe interference and hitting the running rail in the back straight.
--Mr Goodwin read the rule, confirmed and understood by Mr Calder.
--Mr Calder did not admit the breach.
--When questioned by Mr Goodwin, Mr Cameron stated he had gone to the rail due to pressure from Mr Taylor on his outside and hit the running rail.
--No questions from Mr Calder.
--Mr Taylor stated he had pressure from the outside horse KONINI BABE, ridden by Mark Barnsley at the same time there was calling for room.
--Mr Barnsley said he had a little pressure from the outside when Mr Calder was only three-quarters of a length in front.
--Mr Bateup had two films available to demonstrate where just after the start Mr Calder angled his mount inwards when barely one length clear while moving over towards the rail with KONINI BABE from barrier 6, STARK HORIZON from barrier 5, and MISS SHINANAGIN from barrier 4, on its inside. There was a concertina effect back to MISS SHINANAGIN who ran into the rail.
--Mr Calder stated he was clear of KONINI BABE and the only contact between KONINI BABE onto STARK HORIZON was made prior to his inward movement. The inexperience of all horses concerned should each be apportioned a part of the blame. MELLICOUS was a first starter as was MISS SHINANAGIN, and KONINI BABE and STARK HORIZON have had one start each. It is quite clear horses are shying off and ducking in and out.
--Mr Goodwin, in summarising, accepted the jockey's evidence to be credible, however, there was pressure from the outside and Mr Calder was not the required distance clear of Mr Barnsley's mount KONINI BABE, therefore causing the interference.
--Decision:
--In reaching their decision, the committee have taken into account, after viewing the films and hearing all the evidence, acknowledge that interference did occur. However, due to the wayward tendencies and the apparent lack of experience shown by the horses involved, there is some doubt that Mr Calder's inward movement was the sole contributor to the incident. The committee therefore gave that doubt to Mr Calder and dismissed the charge.
