DECISION AND REASONS:

An information was lodged by Stipendiary Steward Mr S. T. Larkins against Mr D. A. Taylor, licensed trainer of Rare Return (3), alleging a breach of Rule 834(1) and (2)(a). It was alleged that Mr Taylor late scratched his horse from Race 9 at

12-10pm today. The reason for the late scratching was that the horse had been sold.

Mr Taylor had indicated on the Information that he admitted the breach of this rule and that he did not wish to attend the hearing. Mr Larkins recommended a fine of $200-00 for this breach as it could have had an effect on Pick 6 investors. After looking at previous penalties for a breach of this rule we were satisfied that the fine suggested was in line with previous penalties. Mr Taylor was therefore fined the sum of $200-00.
