Following the running of race 7 on the programme, an Information was lodged against jockey, M Tanaka, alleging a breach of Rule 871(1)(d) in that, as the rider of Prophet’s Rising, he let his mount shift ground and check Torrent (L Robinson)



Following the running of race 7 on the programme, an Information was lodged against jockey, M Tanaka, alleging a breach of Rule 871(1)(d) in that, as the rider of Prophet’s Rising, he let his mount shift ground and check Torrent (L Robinson) in the home straight.

Mr Tanaka, assisted by trainer, Mr G Barlow, acknowledged that he was familiar with the judicial process, and he admitted the breach.

In presenting the circumstances, Mr Ching referred to the video of the incident. He showed that in the run home Mr Tanaka (Prophet’s Rising), outside Mr Robinson (on Torrent), was having difficulty with his mount as it shifted in. He continued to urge the horse with the stick but, in doing so, he took the line of Mr Robinson, who had to take hold and check out of it. Mr Ching said that, although Mr Tanaka initially attempted to keep his horse straight, it continued to shift in and he kept on riding it out

Mr Tanaka said his horse started hanging from the top of the straight as horses on his outside came around. It kept hanging, so he switched the stick to the left hand but it kept shifting in. He said he realised he took Mr Robinson’s line, and he then stopped riding.

Mr Barlow, on behalf of Mr Tanaka, was then asked if he had anything to add. He said he was inclined to agree with Mr Tanaka in that, from the turn, the horses on the outside had moved in and, whilst there wasn’t contact, perhaps Prophet’s Rising may have reacted to this and moved in with them, and that may have contributed. To this, Mr Ching commented that Mr Tanaka’s mount was racing greenly and laying in.

In respect to penalty, Mr Ching said that Mr Tanaka had an exemplary record, with no previous breaches under this Rule over the last 12 months, and only twice suspended in 2 years. He said credit should be given for this and for his admitting the breach, but the stewards considered this interference in the mid-range, with rider safety being compromised, and he recommended a penalty of between 4 and 6 days.

Mr Tanaka, again openly acknowledging that he ‘ran into’ Mr Robinson’s horse, said he tried to do his best. Speaking on his behalf, and with a suspension being recommended, Mr Barlow offered to speak with Mr Tanaka regarding his options. Following a brief adjournment, Mr Tanaka accepted that a suspension was likely and indicated that he would not seek any deferment.

In this case, Mr Tanaka has been charged with a breach of Rule 871(1)(d) in that, as the rider of Prophet’s Rising, he let his mount shift ground and check Torrent, ridden by L Robinson, in the run home. Our role is to determine an appropriate penalty.

In summary, we have heard how Mr Tanaka allowed his mount to move inward in the home straight, over some distance, causing Mr Robinson to check and drift out. Mr Tanaka has openly admitted the breach and he is also to be given credit for his riding record which, the stipendiary stewards indicate, over the last 2 years has been quite exemplary.

Notwithstanding, Mr Ching indicated that the interference was at the mid-range and he recommended a suspension of between 4 and 6 days.

The committee takes note of the recommendations and, given the interference concerned, accepts that a suspension is appropriate. It is a breach which, in our view, may ordinarily incur a penalty of perhaps 5 days. Giving credit for the points we have referred to, Mr Tanaka is suspended for a period of 4 days, commencing from the conclusion of riding today, up to and including Thursday 8 May 2008.
