Race 5

Decision: --

Following the running of the Dunstan Feeds Championship Final, Mr G Cooksley the rider of FIZZ admitted a charge of careless riding,

--

DECISION AND REASON:

--

Following the running of the Dunstan Feeds Championship Final, Mr G Cooksley the rider of FIZZ admitted a charge of careless riding, under Rule 871(1)(d).

--

The information alleged that as the field turned into the straight Mr Cooksley's mount shifted out when insufficiently clear and caused checks to WINSOME KASH (L Allpress) and REDWINGS (T Harris) which in turn was forced onto DARRINGDO (L Innes).

--

Mr Cooksley and Mr A Coles, Stipendiary Steward, agreed that the films indicated FIZZ rolled out at the turn and Mr Cooksley's carelessness centred on his failure to restrain the extent of this movement. WINSOME KASH, REDWINGS and DARRINGDO suffered significant buffeting in the incident.

--

On the issue of penalty, Mr George, Senior Stipendiary Steward advised that Mr Cooksley previously breached this rule in January and March 2006. Acknowledging Mr Cooksley's good record and his candid admission of the matter, Mr George nevertheless believed the significant interference to several runners at a key point of the race warranted a suspension.

--

Mr Cooksley referred to his record and the fact that the carelessness at issue was not the result of a deliberate action on his part.

--

The committee considered Mr Cooksley's failure to restrain the outward movement of his mount and the consequent substantial interference to a number of runners presents a level of carelessness, which must be met with a suspension. Giving credit for Mr Cooklsey's riding record and his frank acknowledgement of culpability the committee suspended him from the close of racing on the 2nd of January 2007, until the close of racing on the 14th of January 2007, which is 5 race days.
