Decision:

Following Race 6 an information was filed pursuant to Rule 871(1) (d). The informant Mr A. Coles alleged that Ms S. Collett near the 1500 metres allowed her mount LEVI AT LARGE to shift in when not clear of EFINPE (A.Denby) dictating that horse inwards into the line of TEMPLAR (D. Johnson) who was checked, also badly hampered was LALISA HEENAN (J McDonald).



Following Race 6 an information was filed pursuant to Rule 871(1) (d). The informant Mr A. Coles alleged that Ms S. Collett near the 1500 metres allowed her mount LEVI AT LARGE to shift in when not clear of EFINPE (A.Denby) dictating that horse inwards into the line of TEMPLAR (D. Johnson) who was checked, also badly hampered was LALISA HEENAN (J McDonald).

Ms S. Collett did not admit the breach and was represented by Trainer Mrs. J. Good.

Mr Williamson demonstrated the head on and side on video films of the incident. He said Ms S. Collett’s mount had shifted in, placing pressure onto Efinpe when only ¾ length clear. He said Ms Denby had her rightful running line dictated to by Ms Collett. This resulted in sharp checks to Templar and Lalisa Heenan who were racing in close proximity.

Ms Collett asked Mr Williamson if he thought that the horse Efinpe was racing greenly at the 1500 metre point. He said this was not correct in his opinion.

Mrs. Good said she believed the horses racing outside Ms Collett had moved in. Mr Williamson demonstrated on the video films this was not correct.

Ms A. Denby rider of Efinpe was called by Mr Coles to give evidence. She informed the committee that she felt pressure from her outside, which was Ms Collett’s mount and clipped heels. She said Ms Collett’s mount was ¾ length in front of her at the point of the interference. She informed us that she couldn’t move out to relieve the pressure.

Ms D. Johnson rider of Templar was called by Mr Coles to give evidence. She informed the committee that she did receive interference and the pressure had come from her outside, resulting in a sharp check.

Neither Ms Collett nor Mrs. Good when given the opportunity had any questions of Ms Denby or Ms Johnson evidence.

Ms Collett stated her mount was having its 1st start, racing in loose conditions and no contact had been made and she thought she was sufficiently clear when she shifted in. She admitted she heard Ms Johnson yell out and tried to turn her horses head out, but by then the damage had been done. Ms Collett admitted she was not aware Efinpe was racing on her inside when asked by the Chairman.

Mr Coles in summing up stated the Committee had to be clear in their own minds if the interference did take place and advised us to review the films, and placed emphasis on whether the inward pressure from Ms Collett could have been relieved.

Decision and Reasons

--

The Committee reviewed all of the evidence including the videos. In our view there is no doubt that, as the head on and side on films clearly shows, Ms Collett moved inwards when only ¾ lengths clear causing interference to Efinpe who’s rightful running line was dictated to, resulting in 2 other horses been checked. We find the charge proven.

Penalty Submissions

--

Mr Coles said Ms Collett had a very good record with only 1 previous charge of this rule in the last 12 months. He submitted a minimum suspension of 4 days would be appropriate. He said Ms Collett does travel to all North Island race meetings.

Ms Collett said she had firm commitments on July 15th at Tauranga. She confirmed that currently she is not riding in the South Island but was riding all over the North Island.

Penalty

--

The Committee carefully considered all submissions and reviewed the video films and before imposing an appropriate penalty took into account the following:

--

1: Ms Collett’s very good record.
2: Level of carelessness low to mid range.
3: The interference suffered by Ms Denby and Ms Johnson.

--

Accordingly we impose a suspension to start after racing on 15th July and to conclude after racing on 23rd July 2009 (4 Days).
