| -- DECISION AND REASON: --Following Race 6 an Information was filed pursuant to Rule 871(1)(d), Careless Riding, when it was alleged by Mr J Oatham Stipendiary Steward that Mrs Allpress, rider of SHOLA, angled her mount outwards when not the required distance clear of SUPER SEASON (M Hills) causing a sharp check to that runner and subsequent interference to BONNIE TOPAZ (N Harris). --Mrs Allpress admitted the breach. --Mr Robinson (Assistant Stipendiary Steward) demonstrated the video films and showed Mrs Allpress on the running rail directly ahead of Mr Hills on SUPER SEASON. A gap opened up outside Mrs Allpress which Mr Hills commenced to ride his mount into. He was half into the gap when Mrs Allpress angled her mount out sharply when not sufficiently clear which caused him to receive quite a severe check. --PENALTY: --Mrs Allpress said it was the first time SHOLA had raced in blinkers which could have compounded the incident. She admitted it was an error of judgment and asked for a suspension rather than a fine. --Mr Oatham produced Mrs Allpress' record which showed this was her first charge since December 2003. However, he stated Mr Hills did receive quite a severe check and believed a suspension should be imposed. --The Committee carefully considered all submissions and in deciding on the correct penalty took into account Mrs Allpress' excellent record and her guilty plea. However, this had to be balanced against the indiscretion she had committed. She was the cause of quite a severe check to Mr Hills when not the required distance clear. The Committee determined a suspension was warranted and accordingly impose a suspension to start after the conclusion of racing on 11 September 2005 and conclude after racing on 21 September --2005 (3 days). -- |
