Following the running of race number 8 an information was lodged by Stipendiary Stewards under rule no. 865 (1) and (4) alleging that T S & S M Chmiel the co-trainers of Macy  Belle  presented the horse in the parade ring without the identical gear it had raced in at Addington on 4 December 2008.

Following the running of race number 8 an information was lodged by Stipendiary Stewards under rule no. 865 (1) and (4) alleging that T S & S M Chmiel the co-trainers of Macy  Belle  presented the horse in the parade ring without the identical gear it had raced in at Addington on 4 December 2008.

The relevant rules read:

“865 (1)

--

Subject to sub-rule (2) and (3), every horse shall race with the same or identical gear within a 12 day period.”

“865 (4)

--

The trainer and/or person in control of a horse shall present such horse in the assembly area with the same or identical gear, or with such different gear as has been notified to the Secretary, as required by the foregoing provisions of this Rule.”

Mr Ydgren said that when the Stipendiary Stewards inspected Macy Belle prior to the race it was noted that pull down blinds were being worn by the mare which were not worn at her previous start. The charge having been admitted was formally found proven.

Mr Ydgren submitted in respect of penalty that the defendants had admitted the breach immediately, that they had no previous charges over the last twelve months under these rules and recommended a fine only. The Committee after taking into account the submissions of the Stipendiary Stewards agreed that a fine only was appropriate and, accordingly, Mr and Mrs Chmiel were fined the sum of $100.00.
