Following race 1 an information was filed pursuant to Rule 876 (1) when it was alleged by the informant, Mr A Coles, that DANZAHORSE placed first by the Judge interfered with the chances of TINSELTOWN placed fourth by the Judge

Following race 1 an information was filed pursuant to Rule 876 (1) when it was alleged by the informant, Mr A Coles, that DANZAHORSE placed first by the Judge interfered with the chances of TINSELTOWN placed fourth by the Judge. This was alleged to have occurred in the home straight. All connections were informed of the protest.

Present at the inquiry were Mr M Coleman rider of TINSELTOWN, Mr P Moroney trainer of TINSELTOWN representing the owners of that horse, Miss D Johnson rider of DANZAHORSE represented by Mr J Sargent, Mr S Fitzgerald owner/trainer of DANZAHORSE.

Assistant Stipendiary Steward Mr W Robinson demonstrated the video films and showed that during the run down the straight DANZAHORSE was drifting out followed by a sharp movement out and into the line of TINSELTOWN forcing him over considerable extra ground. Mr Robinson stated that in his opinion this movement cost TINSELTOWN third placing.

Mr Coleman said in his statement he was taking ground off the winner and the outward movement from DANZAHORSE cost him at least a length. He believed he could have finished second.

Mr P Moroney confirmed Mr Coleman's opinion of the incident and said the sudden movement from DANZAHORSE took TINSELTOWN over extra ground causing Mr Coleman to check on 2 occasions.

Miss D Johnson rider of DANZAHORSE admitted her horse did move out.

--

Mr J Sargent, on Miss Johnson's behalf, said she was inexperienced, but agreed the horse did run out.

--

Mr S Fitzgerald owner/trainer of DANZAHORSE said that while his horse did move out he believed Mr Coleman had an opportunity to take a run on the inside of DANZAHORSE.

--

Mr A Coles said in summing up that TINSELTOWN was entitled to a clear straight run to the line and this was extinguished by DANZAHORSE moving out approximately 8 horse widths.

DECISION

--

The Committee considered all evidence and repeated viewing the video films. We are clearly of the view that interference was suffered by TINSELTOWN when DANZAHORSE moved out sharply taking his line and forcing him over considerable ground.

--

Secondly, we determine that the chances of TINSELTOWN finishing in a better place were affected.

--

In applying our discretion we uphold the protest because

  • the fourth horse TINSELTOWN was moved out approximately 8 horse widths
  • --
  • the margin between third and fourth was ? of a length at the post
  • --
  • the strong manner in which TINSELTOWN was finishing the race
  • --
  • DANZAHORSE was never the required distance clear when taking the line of TINSELTOWN.

Accordingly the placings shall now be :
