An Information instigating a protest was lodged by Stipendiary Steward Mr T TAUMANU following the running of Race 4 at Cambridge on the 28th June 2007, where it was alleged that Horse number 4, B B GILL, driven by P Fergusson, moved inside the track markers in excess of 30 metres in the final run home.

An Information instigating a protest was lodged by Stipendiary Steward Mr T TAUMANU following the running of Race 4 at Cambridge on the 28th June 2007, where it was alleged that Horse number 4, B B GILL, driven by P Fergusson, moved inside the track markers in excess of 30 metres in the final run home.

Mr Fergusson appeared to represent the interests of BB GILL and conceded that his drive had travelled in excess of 30 metres inside the marker line in the run home. He contested the protest and by reference to video footage of the race indicated where his horse had been forced towards the marker pylons by the inwards movement of TITIAN SUN driven by W THOMAS.

Mr Thomas admitted his horse was hanging but did not force Mr Fergusson onto the pylons. There was clearly space between the sulkies when the pylons were first crossed and Mr Fergusson agreed his horse had overreacted when coming into the passing lane but that this had been caused by the actions of TITIAN SUN.

In upholding the protest I find that although there was minimal inwards movement from TITIAN SUN at the time BB GILL entered the passing lane, the overreaction by BB GILL was the major contributing factor in the horse travelling in excess of 30 metres in the concluding stages of the race. There was insufficient evidence to support the contention that BB GILL's breach was forced upon it by the actions of another horse or horseman.

Subsequently BB GILL is disqualified and the Judges placings are amended as follows
