Following the running of Race 6, Dakins Rent-A-Loo Handicap Pace, at the above meeting, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Public Trainer, Mr M J Smolenski, alleging a breach of Rule 849 (2) in that he presented CLOUD WATCH, trained by him, to race with the incorrect saddlecloth.

Following the running of Race 6, Dakins Rent-A-Loo Handicap Pace, at the above meeting, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Public Trainer, Mr M J Smolenski, alleging a breach of Rule 849 (2) in that he presented CLOUD WATCH, trained by him, to race with the incorrect saddlecloth.
----The information was filed on raceday and served on Mr Smolenski at the meeting of New Zealand Metropolitan Trotting Club at Addington Raceway on Saturday, 31 January 2008 and heard during that meeting. Mr Smolenski was present at the hearing of the information and admitted the breach. The breach was found proved accordingly.
----Rule 849 (2) provides as follows:
--The trainer, horseman or person in control of each horse in the race shall ensure that the proper numbered saddlecloth is attached prior to the horse parading in the assembly area.
----Mr Ydgren informed the Committee that CLOUD WATCH had been noticed in the birdcage prior to Race 6 with the incorrect saddlecloth number (7 instead of 4) and had actually gone out onto the track and had completed its warm up. The numbers were changed prior to the start.
----Mr Ydgren submitted that it is a more serious breach of the Rule to get out onto the track rather than have the error picked up in the parade ring or birdcage. He recommended a fine of $200.
----Mr Smolenski said that he was not present when the saddlecloth numbers were placed on the horse. He had had a runner in the previous race and had taken it out to the float. He was not aware of the error until that evening. He accepted, however, that he had an obligation as trainer of the horse to ensure that the horse had on the correct saddlecloth number. He stated that he had not done it deliberately – this was the first time this had happened to him in 50 years, he said. He accepted that it was more serious because the horse had actually got onto the track and completed its warm up.
----Having regard to Mr Smolenski’s admission of the breach and the submissions of the parties, Mr Smolenski was fined the sum of $200.
