Decision:

Following Race 5 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged that passing the 150 metres Mr M Cameron, riding VIDUKA, allowed his mount to shift out dictating ICE SKATES (B Jones) out and badly crowding LAKELAND QUEEN (N Collett) who clipped heels and was severely checked.



Following Race 5 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged that passing the 150 metres Mr M Cameron, riding VIDUKA, allowed his mount to shift out dictating ICE SKATES (B Jones) out and badly crowding LAKELAND QUEEN (N Collett) who clipped heels and was severely checked.

Mr Cameron pleaded guilty to the charge.

Mr Williamson demonstrated the video films which showed at the 150 metre mark, Mr Cameron, riding VIDUKA, allowed his mount to shift out into the line of ICE SKATES.  Mr Cameron was 1 – 1 ½ lengths clear of Mr Jones when he moved out and this caused Mr Jones’ mount ICE SKATES to also move out and into the line of LAKELAND QUEEN (N Collett).  LAKELAND QUEEN was forced into PANAMA which resulted in Miss Collett becoming very unbalanced.

Mr Cameron, while admitting the breach, said he had drifted out too much but had tried to straighten.

PENALTY SUBMISSIONS

Mr Coles said Mr Cameron had an excellent record with only 1 charge in the last 12 months.  He submitted a 5-7 day suspension would be appropriate.

Mr Cameron said he had commitments up to and including 28 October 2009.

PENALTY

--

The Committee carefully considered all evidence and submissions before imposing a fair and appropriate penalty.  Mitigating factors considered were Mr Cameron’s excellent record and guilty plea.  However these have to be balanced against the aggravating factors of the interference received by Miss Collett.  His carelessness nearly caused her to fall.

Taking all these factors into account we impose a suspension on Mr Cameron from riding in races which starts after racing on 28 October 09 and concludes after racing on 4 November 2009 (5 days).
