| ---- DECISION AND REASONS: --Information 65391 alleged Philip Jefferies (WALKS ON WATER) committed a breach of Rule 869(2)(a) - using the whip in an unnecessary, excessive or improper manner from approximately 450m to just short of the finishing post. The breach was not admitted. ----Mr Van Kan demonstrated the incident on video and asked the Committee to note it showed the whip had been used 25 times from the top of the straight without a break which was excessive and far too much in the view of the Stipendiary Stewards. Mr Jefferies denied striking the horse more than 3 times and said that he had been hitting the sulky shaft. Mr Van Kan said the use of the whip was simply too much in the circumstances whether hitting the horse or the sulky. ----Mr Jefferies confirmed that he was aware of guidelines for the use of the whip but did not accept he had been excessive in the circumstances. A copy of the guidelines was produced and read for his information. ----Taking all these matters into consideration the Committee found a breach had occurred as alleged because the guidelines had not been followed even though it accepted that Mr Jefferies had not hit the horse more than 3 times. ----In considering penalty Mr Van Kan said that Mr Jefferies had been warned in January 2004 but had not been previously charged with a breach of this Rule. It could therefore, be treated as a first offence and a fine of $200.00 was recommended. Mr Jefferies confirmed this was a first offence. ----In imposing the fine the committee accepted the recommendation of Mr Van Kan and ordered that a fine of $200.00 be imposed. |
