Following Race 7 an Information was filed pursuant to Rule 871 (1) (d) by the Informant Mr R Sanders. He alleged that approaching the 1400 metres Mr K Sweeney, rider of ‘Bacchanal Woman’, allowed his mount to shift in taking ‘Princess Annaliese’ (J Riddell) inward crowding ‘Zoe Quinn’ (M Wenn) and ‘Material Girl’ (G Cooksley). As a result ‘Zoe Quinn’ had to be checked.
Following Race 7 an Information was filed pursuant to Rule 871 (1) (d) by the Informant Mr R Sanders. He alleged that approaching the 1400 metres Mr K Sweeney, rider of ‘Bacchanal Woman’, allowed his mount to shift in taking ‘Princess Annaliese’ (J Riddell) inward crowding ‘Zoe Quinn’ (M Wenn) and ‘Material Girl’ (G Cooksley). As a result ‘Zoe Quinn’ had to be checked. Mr Sweeney (an Australian rider) admitted the breach.
--Mr Oatham demonstrated the video films which clearly showed that when the field was approaching the 1400 metres Mr Sweeney riding ‘Bacchanal Woman’ move in taking the line of ‘Princess Annaliese’ (J Riddell) when little more than a length clear of that runner. This inward movement then caused ‘Princess Annaliese’ to shift in with resultant checks to ‘Zoe Quinn’ and ‘Material Girl’. ‘Zoe Quinn’ was the worst affected losing considerable ground.
--Mr Sweeney said he corrected his mount as soon as he heard the call and said it was an error of judgment on his part. He said he had no intention of coming to New Zealand to cause trouble.
--PENALTY SUBMISSIONS
--Mr Sanders asked Mr Sweeney for his record : he said he had only incurred 2 careless charges in the last 2 years. He asked the Committee to take into account Mr Sweeney’s guilty plea and his excellent record. However as this was a Group 1 race Mr Sanders submitted that a 2 – 3 week suspension was warranted and in addition a fine not exceeding $1000.

--The Committee carefully considered all submissions and in particular the following:

His guilty plea
Level of carelessness by Mr Sweeney and the checks received by 3 horses
Status of race being a Group 1
Balancing all these factors we believe a 3 week suspension is appropriate and accordingly we impose a suspension on Mr Sweeney’s race riding license to begin after racing today 4 April 09 and conclude after racing on 25 April 09. In addition we impose a fine of $1000.
