--Prior to hearing submissions on penalty the committee was shown the films of the last 600 metres of the race.
--These demonstrated Mr Aubrey striking NASSA in excess of twenty times prior to reaching the 200m mark. He then proceeded to drive out to the finish of the race.
----When making his submissions Mr McIntyre produced Mr Aubrey's record, this demonstrating no previous breaches of this rule.
--After hearing submissions from both parties the committee finds that Mr Aubrey be fined the sum of $200.00
--In reaching this finding the committee acknowledges Mr Aubrey's ready admission of the breach together with his good record, however against this is the fact that he struck his horse for some duration.
