Decision: Following Race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged that near the 150 meters Mr Peard permitted his mount to shift inwards crowding L Innes (MR COLOMBO)who was forced inwards onto J Waddell

Following Race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged that near the 150 meters Mr Peard permitted his mount to shift inwards crowding L Innes (MR COLOMBO)who was forced inwards onto J Waddell (EBONY STRANGE).

  Mr Peard did not admit the charge.

Mr Williamson demonstrated the videos. He showed at the 300 metres REGAL GAZE was racing a loose 5 horses wide. As the field progressed down the straight REGAL GAZE began an inward movement which put pressure on MR COLOMBUS which in turn put pressure on EBONY STRANGE. Mr Williamson showed where the movement was at least 3 horse widths and at no time could Mr Peard be seen to stop riding his mount.

Mr Peard, in his defence, demonstrated the video of most of the race. He said that REGAL GAZE was a difficult horse to ride. He claimed that he was using his whip in a forward action around the horse’s eyes in an attempt to correct its inward movement.  Because of this action he felt that there was enough doubt as to whether he was guilty of a breach of Rule 871(1)(d) and in such a situation he must be given the benefit of any such doubt.

DECISION:

After reviewing all the evidence the committee is in no doubt that Mr Peard continued to urge his mount forward when it was putting pressure on the horses racing on his inside. Mr Peard’s claim that he was using his whip in a forward position to keep it straight clearly did not work. It is the committee’s view that he should have stopped riding his mount forward and put more emphasis on relieving the pressure on the horses on his inside.

We therefore find Mr Peard guilty as charged.

PENALTY:

--

 Mr Oatham gave Mr Peard’s moderate record of 5 suspensions in the last 12 months. He said that although he did not regard this as a serious breach of the rules his mount had been relegated. He asked for a suspension of 5-7 days.

Mr Peard pointed out that there were Premier races in the North in coming weeks. He asked that any suspension be started after racing on 29 March.
