Following the running of race 6 an information was filed instigating a protest under the provisions of Rule 869 and its sub clauses. The informant was Mr. J.M. Muirhead and this was a protest against the horse Pacific Idol placed 4th by the judge

Following the running of race 6 an information was filed instigating a protest under the provisions of Rule 869 and its sub clauses. The informant was Mr. J.M. Muirhead and this was a protest against the horse Pacific Idol placed 4th by the judge on the grounds that Pacific Idol (Mr. R J Brosnan) caused interference at the crossing with approximately 1700 meters to run. It was alleged that Pacific Idol interfered with Jacks Cuzzy Placed 11th , Caesar's Man placed 6th , Whodatdare placed7th, Mazza D placed 10th ,when Pacific Idol broke from its gait when going over the crossing with 1700 meters to run.

The Judges placings for this race were 1st No 10, 2nd No 14, 3rd No 4, 4th No 1, 5th No 5, and 6th No 6.

Mr R J Brosnan was present at the hearing of this information and acknowledged he understood the rule concerning this protest. Mr. Muirhead showed the video of this incident and this video showed that Pacific Idol had broken from its gait when going over the crossing as alleged. Whodatdare ( Mr. I. J Brownlee) was trailing Pacific Idol at this point of the race and Mr. Muirhead stated that this runner had lost his position and been forced into a break by the horse Pacific Idol coming back and checking this runner. The video showed that jacks Cuzzy, Caesar's Man and Mazza D were all inconvenienced by the breaking Pacific Idol at this point of the race. Mr. I. J. Brownlee the driver of Whodatdare was called to give evidence and stated that his horse had been checked by the breaking Pacific Idol and that his horse had lost about 6 lengths and his position in the race. Mr. Brosnan gave evidence and he stated it was the first time his horse had raced on grass

Having viewed the video of this race and the taken into consideration the evidence as presented by Mr. Muirhead and Mr. Brownlee I find that Pacific Idol did cause interference to the four runners as alleged when breaking from its gait over the crossing. This protest is therefore upheld and as Mr. Muirhead sought disqualification of Pacific Idol from 4th place in this race. I order that Pacific Idol be disqualified from its 4th place and that the amended placings shall now read 1st No 10, 2nd No 14, 3rd No 4, 4th No 5, 5th No 6, and 6th No 9
