Stipendiary Steward Mr T Taumanu laid an information following race 8 alleging that trainer Mr P Norman failed to affix the removable earhood on SWEETIE PIE so as not to malfunction.

Stipendiary Steward Mr T Taumanu laid an information following race 8 alleging that trainer Mr P Norman failed to affix the removable earhood on SWEETIE PIE so as not to malfunction.

Mr Norman appeared before the hearing and denied the charge.

Mr Muirhead told the hearing that shortly after the race Mr T MacFarlane driver of Sweetie Pie was spoken to by him when it was noticed the removable earhood was still in place.
He told Mr Muirhead that despite attempts the removable earhood wouldn’t release.  Mr MacFarlane demonstrated to Mr Muirhead by pulling the cord 2 or 3 times and the earhood still would not release.

It appeared to him that the buckle was caught in the overcheck and wouldnt go any further so therefore couldn’t operate in the manner it was intended.

Mr Taumanu submitted because the earhood did not operate as planned it had malfunctioned and therefore breached the rule

Mr Norman produced the earhood for inspection by the hearing and was at a loss to explain why there had been a malfunction.  In three previous drives with the same horse and setup when driven by Mr McKendry the equipment has worked as intended

Decision

--

The committee is satisfied that the removable earhood did not function as intended and therefore malfunctioned. Video footage of the race reinforced Mr MacFarlanes assertion that he tried  unsuccessfully to remove the earhood.

Mr Taumanu asked for a fine of $250 as a starting point.  Mr Norman had never been before the Stipendiary Stewards before on any matter.

Mr Norman submitted that the breach was unfortunate and that the same equipment had worked properly in the three previous starts.

--

Taking into account the matters above the committee order a fine of $250.

--
