Following the running of Race 2, Mr S. Doyle was charged with a breach of Rule 849 (3). The information alleged that S. Doyle being the rider of LIKENOTHINELSIE did add and remove items of riding gear after weighing out



Following the running of Race 2, Mr S. Doyle was charged with a breach of Rule 849 (3). The information alleged that S. Doyle being the rider of LIKENOTHINELSIE did add and remove items of riding gear after weighing out.

Mr Doyle admitted the breach and was assisted by Mr. J. Wheeler.

Mr George was asked to outline the facts of the matter and make submissions on penalty. He told the committee that during the weighing-out process Mr Doyle returned a couple of times to the jockeys' room to get more gear. When leaning down to pick up his lead bag the girth and surcingle must have fallen off his saddle. After weighing out and giving the gear to the trainer he returned to the jockeys' room and saw the missing items. Mr Doyle then took it upon himself to go to the tie-up stalls and add the missing gear to the saddle that he weighed out with. At the same time, in an effort to compensate, he removed some lead.

Mr Bevage, the Racecourse Inspector, observed Mr Doyle running to the stalls with the missing gear. When questioned soon after by the Stipendiary Stewards Mr Doyle was forthcoming with his explanation. He was required to reweigh with the correct gear prior to the running of the race.

In making submissions on penalty Mr George told the committee that this incident could potentially have been a very serious mistake by Mr Doyle however it was not a deliberate act of trying to weigh out lighter. He said the Stewards would recommend a monetary penalty of between $200 and $400.

Mr Wheeler wanted it noted that Mr Doyle was not trying to cheat the system but he told the committee that Mr Doyle was known to be somewhat absent-minded. In his opinion it was more a case of just not thinking.

In coming to a decision on penalty the committee acknowledged that this was not a deliberate action to cheat the system. There was no intent involved, as Mr Doyle did not have any difficulty in making the correct weight.

The incident was viewed by the committee as a jockey trying to fix up an honest mistake however Mr Doyle was reminded that the adding and removing of gear after weighing out is not something he should ever have attempted. These actions could easily have resulted in serious repercussions.

He was fined the sum of $300.00.
