DECISION AND REASONS:

Following the running of Race 11, Matson’s Brewery Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Open Driver, Mr P J Holmes, alleging that Mr Holmes, as the driver of AWATEA DREAM in the Race, committed a breach of the push-out Rule in that he "forced LAVRA MIRIAM (M P Jones) to race wider on the track with approximately 1100 metres to run".

Mr McIntyre referred to side-on and head-on video replays of the incident. He pointed out LAVRA MIRIAM (M P Jones) towards the rear of the field with approximately 1200 metres to race in a gap and immediately behind AWATEA DREAM, driven by Mr Holmes. Mr Jones then improved to outside the wheel of Mr Holmes, and was progressing forward, when Mr Holmes came out and forced Mr Jones from a 3-wide to a 4-wide position.

Mr Holmes submitted that it was "very marginal", which was not accepted by Mr McIntyre. Mr Holmes said that he was already out before Mr Jones was "past his sulky wheel". He believed he was within his rights to come out. It was "very 50/50", he submitted.

Driver, Mr M P Jones, was then called before the hearing. Mr Jones said that he had been improving 3-wide and was then forced to race 4-wide when Mr Holmes came out "a touch too late". He was unable to get on to Mr Holmes’ back and was forced to race 4-wide. Mr Jones confirmed that his horse’s nose was in line with or past Mr Holmes’ wheel and that he was progressing forward. Mr Jones confirmed that he had thereafter been forced to race 4-wide, then 3-wide and he had finished 2nd in the Race, beaten by a half-length. Being pushed out at the 1100 metres probably cost him the Race, Mr Jones said.

Mr Holmes submitted it was a judgment call and maybe he was "a whisker too late". It was his first drive for 2 years.

Mr McIntyre recommended a fine of $200.

Mr Holmes submitted that a fine of $200, given the marginal nature of the breach and the fact it was his first drive in 2 years, was "very severe".

The Committee was of the view that Mr Holmes’ actions amounted to a clear breach of the push-out Rule. Mr Holmes was fined the sum of $200.
