Following Race 4 an information was filed pursuant to Rule 871(1)(d) by the Informant Mr A Coles.He alleged that near the 100 metre mark GONE FISHIN’ (V Colgan) shifted in when not clear of MINQAR QAIM, resulting in that horse being checked.



DECISION AND REASON:

 Following Race 4 an information was filed pursuant to Rule 871(1)(d) by the Informant Mr A Coles.

--

He alleged that near the 100 metre mark GONE FISHIN’ (V Colgan) shifted in when not clear of MINQAR QAIM, resulting in that horse being checked.

--

Mr Colgan admitted the charge.

--

Mr Williamson demonstrated the video films and showed that at approximately the 100 metre mark Mr Colgan move in approximately 1-1/2 horse widths and take the line of MIZQAR QAIM on the inside when only three-quarters of a length clear of that runner.

--

Penalty:

--

Mr Coles said Mr Colgan had been out of the country for some time but incurred no suspensions in that time while riding overseas.   He submitted a penalty of 4-5 days would be appropriate.

--

Mr Colgan said he did have commitments on Saturday the 16th at Ellerslie.

--

The Committee considered all submissions and took into account the following before imposing a penalty.

--

1.         Mr Colgan’s guilty plea.

--

2.         His excellent record.

--

3.         The carelessness itself was at the lower end.

--

However, Mr Colgan did keep riding forward at all times and Mr Bosson did receive quite a check.

--

Accordingly, the committee imposed a suspension to start after racing on the 16th of February 2008 and conclude after racing on the 23rd of February 2008 (4 days).
