Following Race 1 an Information was filed pursuant to rule 865 (a). This requested a ruling as to whether DIAMOND GLITTER (L Innes) and TRIDANE (M Tanaka) obtained a fair start.

Following Race 1 an Information was filed pursuant to rule 865 (a). This requested a ruling as to whether DIAMOND GLITTER (L Innes) and TRIDANE (M Tanaka) obtained a fair start.

Mr Oatham demonstrated the video films which showed gates 3 & 4 marginally slow to open.

Mr Innes, rider of DIAMOND GLITTER, said his gate did not open at the same time as the others.  He said his plan was to be near the front in the running.  However, because of his slow gate, he was unable to do so and believed he was cost a better place in the running.   He was, nevertheless, unsure if his finishing position was affected.

Mr Tanaka, rider of TRIDANE, said, although his gate was slightly slow, he was going to ride the back anyway and his chances were not affected.

Mr Oatham, in summing up, said the gates were marginally slow to open resulting in Mr Innes beginning awkwardly.  He said neither horse lost ground nor their chances affected.  He said their chances were not materially prejudiced.

DECISION

--

The Committee carefully considered all evidence and reviewed the video films.  While conceding the 2 gates in question did not open simultaneously with the others this only became obvious when viewing the start frame by frame.  Taking the riders evidence into consideration and viewing the race in its entirety we are not satisfied their chances were materially prejudiced.  Important in this decision was where the affected runners finished and the manner in which they did so.

Accordingly the Committee orders that DIAMOND GLITTER and TRIDANE are declared runners.
