At the conclusion of Race 8, The Liquorland Gore Guineas, an information # 5519 was lodged by Stipendiary Steward Mr M Davidson under Rule 638 (1) (d) alleging that Mr S Muniandy, Apprentice Jockey, rider of OUR BEE JAY, allowed his mount to shift inwards near the 75 metre mark from the winning post, causing RAEWYN COUP (Mr J Bates) to be checked.

At the conclusion of Race 8, The Liquorland Gore Guineas, an information # 5519 was lodged by Stipendiary Steward Mr M Davidson under Rule 638 (1) (d) alleging that Mr S Muniandy, Apprentice Jockey, rider of OUR BEE JAY, allowed his mount to shift inwards near the 75 metre mark from the winning post, causing RAEWYN COUP (Mr J Bates) to be checked.
--The Rule reads : ‘A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.’
--Mr Muniandy admitted the breach and was assisted throughout the hearing by his employer, Mr B J Anderton.
--Stipendiary Steward Mr McLaughlin used several video clips of the incident, highlighting the inwards movement of OUR BEE JAY (Mr Muniandy) onto RAEWYN COUP (Mr Bates).
--Stipendiary Steward Mr Davidson stated that the incident had no bearing on the outcome of the race, in his opinion.
--Mr Anderton, representing Mr Muniandy, stated that Mr Muniandy had made an error of judgment.
--DECISION / REASON
The Committee was satisfied that a breach of this Rule had occurred and that Mr Muniandy, riding OUR BEE JAY, has shifted inwards when not sufficiently clear of RAEWYN COUP, ridden by Mr J Bates, causing that horse to be checked.
SUBMISSIONS ON PENALTY
--Mr Davidson believed the breach of the Rule was mid range. He stated that Mr Muniandy had received two previous suspensions under the same Rule in the past twelve months – on 01 August 2009 at Riccarton – 3 days, and on 04 November 2009 at Wingatui – 3 days. Mr Davidson stated that Mr Muniandy was an apprentice jockey, having between six to eight race day rides at the majority of South Island meetings. Mr Muniandy does not ride at North Island meetings.
--Mr Anderton stated that Mr Muniandy was a busy rider and had admitted the breach on this occasion.
--PENALTY
The Committee was satisfied that the breach of the Rule was in the mid range of carelessness and that although Mr Muniandy was a busy, successful apprentice jockey, this was a third breach of this Rule in the past twelve months. Some consideration was given to Mr Muniandy, when fixing penalty, for his early admittance of the breach.
Mr Muniandy was suspended from race riding from the conclusion of riding on Saturday 23 January until the conclusion of racing on Wednesday 03 February 2010, effectively three South Island riding days.
