Ms Spittles was charged with a breach of rule 871(1)(d), careless riding, in that in race 5 she permitted her mount MUIR HILL to shift out when not sufficiently clear

Ms Spittles was charged with a breach of rule 871(1)(d), careless riding, in that in race 5 she permitted her mount MUIR HILL to shift out when not sufficiently clear of THORNLEA BAY (J Todd) causing that horse to check near the 450 metres. She informed the Committee that she admitted the breach.
----Mr J Davidson had Mr M Davidson, assistant stipendiary steward, demonstrate on the video that Ms Spittles allowed her mount MUIR HILL to shift outwards when turning for home causing a severe check to THORNLEA BAY. He produced Ms Spittles' record which showed a suspension of 2 days on October 14 2006 and 2 days on 1 January 2007. After discussing the matter with Ms Spittles, she agreed the latter penalty was 1 day at Omakau (14 races) and a fine of $150 which the Committee equated to 2 days suspension.
----We take a starting point of 5 days suspension as we believe this breach to be to the higher end. Ms Spittles moved out what we conservatively assess to be 2 horse widths and Mr Todd was very lucky not to come off his horse as a consequence of the interference. We are concerned at three suspensions over a relatively short period of time by an apprentice. We are aware an apprentice needs to ride to obtain the necessary experience, but equally there has to be a deterrent element to the penalty. We are prepared to reduce the suspension to 3 days having regard to Ms Spittles' ready admission of the breach and the fact that she clearly did look before making her outwards movement but unfortunately appears not to have seen Mr Todd's mount. She is suspended from riding at the end of racing today up to and including Saturday 24 February 2007. This is 3 South Island days. We remind her of her responsibilities under the Rules of Racing.
